Terms of Service
These Terms of Service ("Terms") govern your use of cardiq.pro and the CardIQ services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who We Are
CardIQ is a digital business card platform operated by CardIQ ("we," "us," "our"). For privacy questions, see our Privacy Policy.
2. Eligibility and Account
- You must be at least 16 years old to create an account.
- You must provide accurate information and keep it up to date.
- You're responsible for everything that happens under your account, including the security of your password.
- You may not share your login credentials. Each individual user needs their own account.
- One account per person. Don't create accounts under false identities.
3. Subscription Plans, Trials, and Billing
Free trial
New accounts get a 14-day free trial with access to features at the trial tier. No credit card is required to start the trial. At the end of the trial, you can upgrade to a paid plan or your account will become read-only.
Paid plans
Paid plans (Starter, Pro, Team) are billed monthly via Stripe. Prices are listed on our pricing page and may change with at least 30 days notice. By starting a paid subscription, you authorize recurring charges to your payment method until you cancel.
Cancellation
You can cancel anytime from Dashboard → Billing → Manage Subscription. Cancellation takes effect at the end of the current billing period — you keep access until then. There's no penalty for cancelling.
Refunds
Subscription fees are non-refundable, except where required by law. If you believe you were charged in error, email support@cardiq.pro within 14 days and we'll review.
Failed payments
If a renewal payment fails, we'll show a banner in your dashboard and Stripe will retry. If payments fail repeatedly, your account may be downgraded or suspended.
4. Acceptable Use
Don't use the Service to:
- Impersonate another person, business, or brand without authorization.
- Post content that is illegal, hateful, defamatory, fraudulent, harassing, or sexually explicit.
- Distribute malware, phishing links, or otherwise harm visitors to your card.
- Send unsolicited bulk messages (spam) using contact data captured by your card.
- Scrape, reverse engineer, or interfere with the Service or its underlying infrastructure.
- Use the Service in ways that violate applicable law (including export, sanctions, and privacy laws).
- Bypass rate limits, account limits, or paid feature gates.
- Resell or sublicense the Service without our written agreement (Team and reseller plans excepted per their terms).
We may suspend or terminate accounts that violate these rules. Severe violations may be reported to authorities.
5. Your Content
You own the content you put on your card (photos, bio, contact details, custom links, etc.). By uploading content, you grant CardIQ a worldwide, royalty-free license to host, display, and distribute that content as needed to operate the Service. The license ends when you delete the content or your account, except for backup copies as described in our Privacy Policy.
You represent that you have the rights to all content you upload and that it doesn't infringe anyone else's rights.
6. CardIQ's IP
The CardIQ Service, name, logo, design, code, templates, and documentation are owned by CardIQ and protected by copyright and trademark law. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service. We reserve all rights not expressly granted.
7. Lead Capture and Contact Data
If you enable the lead form on your card, visitors who submit it are sharing their personal data with you. You are the data controller for those leads. You're responsible for:
- Disclosing how you'll use the data (we surface a consent checkbox you can configure).
- Honoring requests to access or delete data submitted to you.
- Complying with anti-spam laws (TCPA, CAN-SPAM, CASL, GDPR consent rules) before contacting leads.
- Maintaining your own privacy notice if your jurisdiction requires it.
CardIQ acts as a processor on your behalf for lead data flowing through the Service.
8. Third-Party Services
The Service integrates with third parties you connect (CRM providers like GoHighLevel, your own webhook endpoints, Apple Wallet, Google Wallet, etc.). Your use of those services is governed by their own terms. CardIQ is not responsible for third-party service availability, content, or policies.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T GUARANTEE THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDIQ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
11. Indemnification
You agree to indemnify and hold CardIQ harmless from claims arising out of (a) your content, (b) your use of the Service, (c) your violation of these Terms, or (d) your violation of anyone else's rights, including privacy and IP rights.
12. Termination
You can stop using the Service and delete your account at any time. We can suspend or terminate accounts that violate these Terms or abuse the Service. On termination, your access ends and your data is removed per our retention schedule (see Privacy Policy).
13. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms. We'll notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after the effective date means you accept the updated Terms.
